海关联盟技术法规TR CU 007/2011《关于儿童和青少年产品的安全性》包括应适用于儿童和青少年产品（下称产品）的安全要求。技术法规涉及化学、生物、机械和热安全，以保护儿童和青少年的健康和生命安全，以防止可能误导或欺骗消费者的行为。

TR CU 007/2011 《关于儿童和青少年产品的安全性》法规旨在确保应用和执行海关联盟境内儿童和青少年产品的统一安全技术要求，并确保货物的自由流通。

产品符合TR CU 007/2011《关于儿童和青少年产品的安全性》技术法规要求是货物进入海关联盟内销售的先决条件。此外，产品还必须经过强制性合格评定程序，并标有欧亚经济联盟合格标志（EAC标志）。

本法规已于2011年9月23日通过，于2012年7月1日生效。从此日期起，市场上只有符合TR CU 007/2011法规并且标有强制性EAC标志的产品才能投放欧亚联盟成员国市场。

 

TR CU 007/2011《关于儿童和青少年产品的安全性》的应用领域：

技术法规适用于：供儿童和青少年使用的成品，未使用的产品，不论其来源哪个国家只要在海关联盟成员国境内销售的产品。

 

TR CU 007/2011《关于儿童和青少年产品的安全性》适用于：

1、儿童护理用品（奶头、橡皮奶嘴、器皿、餐具、卫生保健品和日用小百货、牙刷和牙床按摩器）

2、童装（服装、纺织面料、毛皮和皮革制品、针织品、成件的纺织成品）

3、儿童鞋（鞋和革制服饰用品）

4、婴儿车和自行车

5、儿童书籍和杂志（教科书、书籍、杂志）、电子类教学出版物）

6、学生文具

 

适用于TR CU 007/2011《关于儿童和青少年产品的安全性》的产品清单，见“技术规则”附件1

 

TR CU 007/2011不适用于以下产品：

1、医疗产品

2、婴儿食品

3、香水和化妆品

4、体育运动用品和运动器材

5、学生练习本

6、玩具和棋类

7、家具

8、个人定制产品

9、二手旧产品

 

合格评定程序（认证程序）

TR CU 007/2011《关于儿童和青少年产品的安全性》要求符合性评估关于儿童和青少年产品的安全性采用以下形式：

1、EAC Certificate （合格证书）

 

2、EAC Declaration （符合性声明）

3、State registration certificate（国家注册证书）

 

根据TR CU 007/2011的要求，只有在欧亚联盟（原海关联盟）境内设立的公司才可以申请认证。对于外国公司可以授权代表可以承担此任务。

 

根据TR CU 007/2011法规以下产品受EAC Declaration （符合性声明）管制：

1、1岁以上儿童外套

2、1岁以上儿童使用冬季头套（帽子）由毛皮和织物制成,羊毛鞋

3、书籍和杂志

EAC Declaration(符合性声明)有效期：如果测试协议由认可的测试实验室颁发则EAC声明的有效期最长为5年或者如果基于公司内部证明确认符合性EAC声明的有效期最多3年。

 

根据TR CU 007/2011法规以下产品受EAC Certificate （合格证书）管制：

2.儿童用卫生用品：用于塑料和金属制成

10.鞋类（不包括羊毛毡鞋类）

EAC Certificate (合格证书)有效期：最长为5年。

儿童和青少年产品受海关联盟国家注册管制产品在进入关税同盟市场前必须由海关联盟成员国的国家卫生与流行病控制当局进行登记注册。

 

根据TR CU 007/2011法规以下产品受State registration certificate（国家注册证书）管制：

1、奶嘴

2、乳胶、橡胶或硅胶制品

3、一次性卫生产品（尿布，三角裤，湿巾，棉签）

4、适合3岁以下儿童的餐具

5.儿童牙刷

6.适用于3岁以下儿童牙床按摩器及类似产品

7.适合3岁以下儿童的内衣

8. 适合3岁以下儿童的针织长袜产品

9.适用于3岁以下儿童的夏季头套（帽子）

所有已注册产品的数据存储卫生部服务器中。

 

海关联盟国家注册证书（State registration certificate）有效期最长为无限期。

 

EAC标记（EAC Marking）：

产品已经获得TR CU 007/2011应该使用海关联盟认证合格的标志（EAC Marking:）。必须直接贴上产品。

 

产品标签还需要包括如下内容：

1.产地国；

2.制造商（销售商或者外国制造商的全权代表）公司名称；

制造商（销售商或者外国制造商的全权代表）地址；

3.产品名称和（或者）类型（用途）；

4. 市场流通标志；

5. 生产日期和产品使用期限（必要时）；

6.使用者年龄（必要时）。

信息应当使用俄语。

不得使用“纯绿色”、“矫形”以及其它无相关证明的类似说法。

对于进口产品，允许有产品制造国的拉丁字母记录以及制造商公司名称和外国制造商地址的记录。

必要时产品标记（根据产品类型）应当包括下列补充信息：

产品使用手册和特殊预防措施说明；

产品正确使用方法；

原料的种类和质量比、产品维护方法；

产品规格；

产品专用者的极限许可质量；

根据产品类型其它必要信息。

奶嘴和奶头的标记应当标绘在封闭的包装盒上并包含使用说明和产品卫生护理说明。儿童护理用一次性卫生产品应当有说明，说明中应包含用途、规格、正确选择产品类型和尺寸的建议、产品维护方法及有效回收利用（必要时）的信息。

作为强制性要求的补充，玩具的标记应当说明玩具推荐使用者的年龄、维护方法（软填充玩具）、消费者组装玩具的说明（手册）、警告标志、安全使用说明，对于承担使用者体重的玩具还应有极限载荷（使用者质量）的说明。

袋口周长大于 380毫米、用于包装玩具的聚合物膜袋，其膜的厚度应当不小于 0.038毫米（热收缩膜和穿孔膜除外），聚合物膜袋不应借助系紧线绳、带子或者类似产品来系合。

作为强制性要求的补充，纺织材料、皮革、皮毛制品和服装、针织产品和单件针织成品的标记应当有下列信息说明：

产品面料和衬里中天然原料和化学原料的种类和质量比（百分比含量）（原料百分比含量实际数值的偏差不应大于 5%），以及毛皮的种类及其加工类型（染色或者未染色）；

根据标准尺寸等级的产品尺寸；

俄罗斯联邦采用的产品维护标志和（或者）使用过程中产品维护特点说明（必要时）。

新生儿内衣产品随附说明“使用前必须洗涤”。

鞋的标记应当有产品尺寸、号码、型号和（或者）货号、商标或品牌（如果有）信息。

童推车和自行车（每个产品）应当有使用说明并注明产品专用者的年龄（或者质量），还应有安装、调节、安全使用和储存的说明。

EAC认证流程：

婴幼儿产品 State registration certificate（国家注册证书）

The technical regulation of the Customs Union TR CU 007/2011 On safety of the products for children and teenagers consists of safety requirements that shall be applied to the products for children and adolescents. The technical regulation refers to chemical, biological, mechanical and thermal safety for the protection of life and health of children and adolescents, as well as the prevention of acts which might deceive consumers.

The TR CU 007/2011 is designed to ensure a uniform application and enforcement of the requirements for products for children and young people across the territory of the Customs Union and to ensure the free movement of goods.

The compliance with the requirements of the technical regulation TR CU 007/2011 is a prerequisite for the admission and marketing of goods within the Customs Union. In addition, the products are subject to the compulsory conformity assessment procedure and shall be marked with the uniform EAC marking of the Eurasian Economic Union.

Until February 15, 2015, the products which conformed to the national standards of the Member States of the Customs Union could be placed on the market. The conformity assessment could be proved, for example, in a GOST certificate prior to the entry into force of the technical regulation. However, from this date onwards, only products on the market which have been issued in accordance with TR CU 007/2011 and marked with mandatory EAC marking may be placed on the market.

Application area of TR CU 007/2011

The technical regulation applies to finished, unused products which are intended for children and teenagers and are released for free circulation in the territory of the Member States of the Customs Union, irrespective of the country of origin.

TR CU 007/2011 is applied to:

• care products for children (soothers, crockery, cutlery, hygiene products)
• children's clothing
• children's shoes
• prams and bicycles
• children's books and magazines
• school stationery

The list of products subject to the application of the TR CU 007/2011 On safety of the products for children and teenagers is set out in Annex 1 to the Technical Regulations.

TR CU 007/2011 is not applied to:

• medical products
• baby food
• perfume and cosmetics
• sport articles and sports equipment
• teaching materials, textbooks, etc.
• toys and board games
• furniture
• custom-made products

Conformity assessment process

The conformity assessment with the requirements of the Technical Regulation TR CU 007/2011 On safety of the products for children and teenagers is carried out in the following forms:

• EAC Certificate
• EAC Declaration
• State registration

In accordance with the requirements of the TR CU 007/2011, only the company established in the territory of the Customs Union may apply for conformity assessment. For foreign companies, an authorized representative can undertake this task.

According to TR CU 007/2011 the following devices are subject to the EAC Declaration:

The following product groups are subject to the conformity assessment in the form of the EAC Declaration:

1.     outerwear for children from 1 year

2.     winter head covers made of fur and fabric for children from 1 year

3.     wool shoes

4.     books and magazines

The validity of an EAC declaration is up to 5 years if the test protocols are issued by an accredited test laboratory or up to 3 years, in the case of a confirmation of conformity on the basis of a company-internal proof.

According to TR CU 007/2011 the following devices are subject to the EAC Certificate:

The following product groups are subject to the conformity assessment in the form of the EAC Certification:

1.     hygiene articles for children's care made of rubber

2.     hygiene articles for children's care of plastic and metal

3.     bed linen

4.     underwear

5.     socks

6.     outer garments

7.     head covers for children up to 1 year

8.     outerwear for children up to 1 year

9.     clothes and head covers made of fur for children up to 1 year

10.  footwear, excluding footwear made of wool

11.  stroller

12.  cycles

The EAC Certificate is valid for up to 5 years.

State registration of products for children and teenagers

The state registration of products takes place when they are placed on the market of the Customs Union.
The state registration of products is carried out by the national monitoring authorities of the Member States in the field of sanitary and epidemiological control.
The following products are subject to state registration:

1.     milk pacifier

2.     dummy of latex, rubber or silicone

3.     hygienic disposable products (diapers, briefs, wipes, cotton swabs)

4.     crockery and cutlery for children up to 3 years

5.     children toothbrushes

6.     gummirauler and similar products for children up to 3 years

7.     underwear for children up to 3 years

8.     knitted stocking products for children up to 3 years

9.     summer head covers for children up to 3 years

The data on the registered products are stored in a single register.

The state registration is valid for up to 5 years.

EAC Marking:

The products, which conformity with the requirements of TR CU 007/2011 has been confirmed, shall be marked with the EAC sign of the Customs Union. The marking itself must be affixed directly to the product or to the corresponding shipping documents.

In addition to the EAC marking, the marking shall include the following:

1.     country of origin

2.     name and address of the manufacturer or his authorized representative

3.     name and purpose of the products

4.     date of manufacture

5.     shelf life

The corresponding information shall be printed in Russian or in the official language of the Member State of the Customs Union in which the products are imported.

Designations such as "environmentally-friendly", "orthopedic", etc., may not be used without corresponding proof.

The labeling of dishes must include information on the material from which the product has been made and the appropriate instructions for use.

When labeling clothing, it is necessary to provide a percentage of the composition of the materials and instructions for care.
The marking of footwear must include information on size, materials, and care instructions.

The marking of backpacks and briefcases must contain information about the age of the user.

Clothes for newborns and children up to 1 year must contain the indication "Pre-wash is required".

Baby carriages must contain instructions for use with the age of the children for which they are intended, as well as the assembly, installation instructions, and warranty information.

Bicycles must contain user instructions with user weight and age, installation recommendation, and warranty information.

Period of validity of the EAC certificate

The certificate for series production is valid for 5 years.
