Goods that end up on the domestic market of our country must meet a number of quality criteria. To verify this compliance, they undergo a certification procedure, after which they receive a declaration of conformity (certificate) and are labelled with the EAC mark. The presence and correctness of such labelling is controlled by customs and in case of detection of violations customs authorities call for administrative responsibility.



According to statistics, the number of violations in the registration of imported products has recently increased, which leads to a slowdown in the development of foreign economic activity. Customs control promises only to become stricter, so it is important to know what EAC is, the requirements for labelling and the peculiarities of obtaining the mark on packaging.


What does the EAC mark on packaging mean: deciphering?


EAC is an abbreviation for Eurasian Conformity. Labelling with this abbreviation is applied to goods that have passed the tests established by international technical regulations. These three letters mean that the product meets the requirements set to it - it is safe for use without harm to health. This fact is confirmed by a declaration of conformity of the Customs Union or a certificate.


EAC labelled products are understandably more in demand on the market. That is why manufacturers are ready to spend both time and money on inspections to increase the number of partners and consumers.


Why do I need EAC labelling?


Products have been labelled with the EAC since 2013. The single mark is a common symbol for the European Union, which indicates the compliance of products with the declared requirements. The described labelling defines the "quality bar". It helps to protect consumers from dangerous products and reduce the number of counterfeit goods.


Usually products are labelled before entering the territory of the Union - at the production site. This is the task of the importer or the manufacturer itself (if the goods are produced in the territory of the EAEU).


There are cases when the mark is applied only in the customs area. For example, if the EAU mark was not applied on the goods received at customs or was applied incorrectly. In this case, the product passes the customs point only conditionally - it remains in the warehouse for further labelling. Once the procedure is completed, Customs releases the goods for circulation.


Which goods must "bear" the EAC mark?


According to the current legislation of our country, the EAC mark must be on goods of the following groups:


pyrotechnics;

children's goods, products for teenagers;

perfumes and cosmetics;

food products, including dietary, preventive and medicinal products;

furniture;

low-voltage equipment;

tobacco products.


This is only an incomplete list of goods that are subject to labelling. That is why foreign trade participants should enquire in advance whether it is necessary to put a mark on a certain product. Such tactics will allow them to "insure" themselves against fines and other problems with the FCS.

A certain list of rules that any manufacturer must observe is contained in the technical regulations. It contains requirements for the safety of goods and the process of confirming the quality of products. Usually this fact is confirmed after a number of tests, as a result of which the product confirms excellent quality and safety for the life of the buyer.


The samples of the product taken must be transferred to a laboratory where the tests are carried out. The goods are tested on the following points:


safety for life and health;

type of material of manufacture (for children's products);

flammability;

radiation safety, etc.

After successfully passing this mandatory procedure, the goods acquire the EAC labelling. If the GOST requirements have not been confirmed, the labelling will be refused.

The Technical Regulations contain certain rules for affixing the EAC mark on goods:


the size of the marking is arbitrary, but the proportions of the mark are defined by GOST. A clear image is black or white (if the background is light). It must be clearly recognisable to the naked eye;

it is important that the applied sign is wiped and not smeared or blurred;

marks of non-food products must be preserved during the whole warranty period;

goods must not be labelled if the validity period of the certificate has expired;

if the expiry date of food, medicines, cosmetics and other types of goods has expired, labelling should not be used;

if the goods of the Customs Union, Europe and other countries cross the border of the Russian Federation for use other than for the intended purpose, they are not labelled, and the existing signs can be erased.

Labelling rules for food and non-food products are different. In the first case, labelling includes the name, grade, variety of the product, its manufacturer, weight, composition, nutritional value, etc. For products, information is indicated that confirms the conformity of the product to the regulatory legal document on the basis of which the product was manufactured.


When labelling non-food products, the name, manufacturer, main properties of the product, its purpose, conditions of safe use are indicated. As in the case of food products, non-food products must meet the requirements of the regulatory legal document.



Labelling does not contain advertising or other type of information. This requirement is relevant in the case of absolutely all groups of goods.

Who applies the EAC mark?

The labelling is done by the manufacturer or the responsible supplier, but always before the direct use of the product. The recipient (not the final consumer) can also assume this responsibility.

The labelling mark is placed directly on the product or packaging. It must be written in full - only individual elements of the mark cannot be applied. The marking is also not applied in case of damage to the packaging of food or non-food products.


Obtaining the EAC conformity mark

It is possible to apply the conformity mark to a product only after confirming that it meets the requirements of the TR CU EAC. This fact can be confirmed by both a certificate of conformity and a declaration of conformity. Both documents have identical legal force. The process of obtaining documents in each case is as follows:


Apply to the Certification Centre with the necessary certificates, references and details.

Wait until the prototypes have passed all the necessary laboratory tests.

Familiarise yourself with the results of the procedure - read the protocols.

If the tests are successful, you will receive a certificate with the date of issue.

Usually, it takes 30 working days to receive the relevant document. The price of services is formed depending on such factors as the cost of laboratory tests and the cost of registration of the certificate or declaration.



If the product is to be checked on several points of conformity at once, and you need to register only one certificate or declaration, you will need a package of protocols to obtain it. The price of the Centre's services will increase significantly.



How to avoid problems with product labelling?


Despite the fact that labelling of goods should be the responsibility of the manufacturer or supplier, it is not worth relying on them to fulfil their obligations in good faith. It is much more reliable to take control of this issue and use the services of a customs clearance company. If you decide to do the labelling yourself, proceed according to the following plan:


Agree a sample image and its localisation with the Certification Authority in advance.

Send the sample agreed with the authority to the manufacturer (supplier).

Set out the obligations of the parties to the transaction with regard to product labelling in the contract.

If necessary, request documentary proof of the correctness of labelling from the manufacturer or supplier of the product (photo report or video).


If you receive goods without the EAC mark, you can solve the problem yourself. In such cases, the "bonded warehouse" procedure can help. However, you should be prepared for a lengthy process.
